Tale Ember Terms of Service

These terms are a pre-launch draft under legal review.

1. Purpose and operator

These Terms of Service ("Terms") govern your use of Tale Ember, the AI character and story role-play service (the app and related websites, the "Service"), provided by ERDCLOUD, INC., a Delaware corporation ("we", "us", or the "Tale Ember team"; representative: Jang SungYong; address: 434 Seowon-daero, Wonju-si, Gangwon-do 26485, Republic of Korea).

2. The Service

  1. The Service lets you chat with AI characters, play through stories, and adventure in worlds with game elements such as items, maps and battles.
  2. You can create characters, plots (story settings) and lorebooks for yourself or publish them to other users, and generate images with AI in some features.
  3. Game numbers (combat, rewards, items, etc.) are calculated by rules on our servers; the AI narrates the results.
  4. We may improve or change the Service. We will give advance notice in the app or on this website of significant changes that are unfavorable to you.

3. Notice about AI-generated content

  1. Character dialogue, stories and generated images in the Service are created automatically by artificial intelligence (AI), not written by a real person. The app reminds you of this when a conversation starts and periodically while you use it.
  2. AI output may be inaccurate, untrue or inappropriate. Do not rely on it as professional medical, legal, financial or mental-health advice. AI characters are not licensed professionals.
  3. If a conversation shows signs of a crisis such as self-harm or suicide, the app shows contacts where you can get help. If you are in immediate danger, call your local emergency number right away.
  4. To process AI requests, your conversation content is sent to external AI providers. See the Privacy Policy for details. If you do not consent to this transfer, you cannot use the AI chat features.

4. Accounts

  1. The Service supports social sign-in only (Google, plus Sign in with Apple on Apple devices). There is no separate username or password.
  2. On first use you choose a server (zone). Your data is stored only on the server you choose. If the same social account already has an account on another server, a new account cannot be created and you will be directed to the original server.
  3. You are responsible for your account and may not share, transfer or sell it.
  4. You can delete your account at any time in the app under Settings > Account > Delete account (Section 14).

5. Age requirements and Adult mode

  1. Before sign-up we ask for your birth year and month. You may not use the Service if you are under 13. Each server may set a higher minimum age (14 by default), which is shown in the app. If you are below the minimum age, use of the account is restricted.
  2. You must not misstate your age. If app-store age signals or signals during use indicate that you are a minor, we may restrict features accordingly.
  3. Adult mode is an optional feature that allows horror, graphic violence, strong language and mature themes (sexually explicit content is not allowed, even in Adult mode). It is off by default and you can turn it on yourself only if all of the following are met: the app-store age rating requirements, an age of 18 or older as declared at sign-up, no signals that you are a minor, and the server you use offers Adult mode. We currently do not require ID verification, but we may add an age-verification step if the law requires it.

6. Ember

  1. Ember is an in-service usage unit that represents the cost of features such as AI chat and image generation. It is separate from in-game currency (such as gold), and cannot be exchanged for cash or other goods or transferred to other users.
  2. Sign-up grant: New accounts receive Ember once (the amount shown in the app; 10,000 Ember by default). If you delete your account and sign up again with the same social account, the grant is not given again.
  3. Usage charges: When you use a feature, we deduct Ember equal to the actual AI processing cost plus a fee. The conversion rate and fee are the values shown in the app (by default: US$1 = 10,000 Ember, 40% fee); changes apply only to charges made after the change. You can see your charges on the Ember screen in the app.
    • Requests that fail with an error and produce no result, and responses blocked by the safety filter, are not charged.
    • If you stop a response midway, you are charged for what was used up to that point.
    • A response that has started is completed, so your balance can go below zero. If your balance is lower than the estimated cost, you cannot start a new request.
  4. Rewarded ads: When you run low on Ember, you may choose to watch a rewarded ad to the end and receive Ember (the amount per ad and the daily limit are shown in the app; by default 50 Ember and 20 ads per day). Rewards are granted only after the ad provider’s server confirms the view. We do not show ads while you have enough Ember.
  5. Purchases: You can buy Ember as in-app products on the App Store and Google Play. Prices and payments are handled by each store. Ember you bought (purchased Ember) and Ember you received for free (sign-up grant, ad rewards, product bonuses and grants from us — bonus Ember) are recorded separately, and bonus Ember is used first.
  6. Refunds:
    • Only remaining purchased Ember can be refunded. Bonus Ember is not refundable.
    • When you request a refund on the Ember screen in the app, the entire refundable purchased amount at that moment is refunded, without a fee, at the conversion rate in effect at the time of the request (partial refunds are not accepted). If your balance is below zero, the refundable amount is reduced accordingly.
    • The requested Ember is held and cannot be used until the request is processed, and you can cancel the request before it is processed. We aim to process requests within 7 days of the request date.
    • You cannot receive both an app-store refund and this refund for the same purchase. If the store refunds a purchase, the corresponding purchased Ember is deducted.
    • The actual refund method may depend on the policies of the store you paid through and will be explained during processing. Where applicable law gives you more favorable withdrawal or refund rights, those rights apply.
  7. Ember currently has no expiration date. We will give advance notice if we introduce one.
  8. If you delete your account, any remaining Ember is forfeited. Before deletion, the app shows your refundable purchased Ember and suggests requesting a refund; if a refund request is in progress, deletion happens after it is processed.
  9. Ember obtained by improper means (automation, exploiting defects, manipulating rewards, etc.) may be reclaimed and your use may be restricted.

7. Servers and server transfers

  1. Servers are shown only by names such as "Zone 1". Your data exists only on the server you chose and is not shared between servers.
  2. You can request a transfer of your account to another server in the app settings. After a transfer completes, you must wait a set period (shown in the app; 24 hours by default) before transferring again.
  3. Your account is locked during the transfer, and data on the original server is deleted when the transfer completes. Your Ember balance and history move with you. Records tied to other users, such as likes, comments, follows and reports, are not transferred.
  4. You cannot transfer while a refund request is in progress.

8. Your content

  1. You own the rights to the characters, plots, lorebooks, images, conversations and other content you create ("Your Content").
  2. You grant us a worldwide, royalty-free, non-exclusive license to use Your Content to the extent needed to operate, provide and improve the Service (storage, AI processing, display, showing it to and letting other users play it if you publish it, and safety checks). This license ends when you delete the content or your account. However, so that stories other users are already playing do not break, a read-only copy of a published plot those stories rely on may remain, without your name.
  3. You must have the necessary rights to Your Content and must not infringe others’ copyrights, publicity rights or privacy.
  4. AI-generated output may be similar or identical to output generated for other users.

9. Prohibited conduct

The following is prohibited in every mode and setting:

  1. Sexual content involving minors or characters who appear to be minors
  2. Sexual depictions of real people, deepfakes, and non-consensual intimate imagery (NCII)
  3. Sexually explicit content
  4. Content that promotes or instructs real-world violence, self-harm or crime, or is otherwise illegal under applicable law
  5. Content that infringes others’ copyrights, trademarks or other rights; impersonating others
  6. Circumventing safety filters or sharing ways to do so
  7. Using bots or automation, sharing an account among several people, or obtaining Ember or rewards improperly
  8. Attacking or reverse-engineering the Service or its servers, or disrupting normal operation
  9. Misstating your age; harassing other users or collecting or exposing their personal information

10. Moderation, reports and enforcement

  1. For safety, we check input and output text with automated rules and AI classifiers, and automatically screen uploaded and generated images. Images may be hidden from other users until reviewed, inputs that break the rules are rejected, and responses may be replaced with a notice.
  2. You can report plots, lorebooks, messages, comments and creators in the app (including copyright infringement) and block other users. We aim to remove non-consensual intimate imagery within 48 hours of confirming a report.
  3. If a violation is confirmed, we may, depending on its severity, issue a warning, restrict features (such as creating or commenting), suspend the account for a period, or ban it permanently, and may hide or delete the violating content. We tell you the reason and duration when we act.
  4. You may appeal within 30 days of learning of an action, and we aim to respond within 15 days.

11. Changes to and suspension of the Service

  1. We may temporarily suspend all or part of the Service for maintenance, outages, or circumstances of our providers (AI, payments, ads, etc.).
  2. If we end the Service, we will announce it in the app or on this website at least 30 days in advance and explain how to get refunds for remaining purchased Ember.

12. Limitation of liability

  1. We do not guarantee the accuracy, completeness or suitability of AI-generated content.
  2. We are not liable for damages caused by force majeure, by your own fault, or by outages of third-party services outside our control, except for damages caused by our intentional misconduct or gross negligence and where liability cannot be limited under applicable law.
  3. If you violate these Terms or the law and cause damage to us or a third party, you are responsible for that damage.

13. Changes to these Terms and renewed consent

  1. We may change these Terms to the extent permitted by applicable law. We will announce the effective date and the changes in the app or on this website at least 7 days before they take effect (30 days for changes unfavorable to you).
  2. These Terms and the Privacy Policy have a version (revision date). After a significant revision, the app asks for your consent again. If you do not consent, your use of the Service may be restricted and you may delete your account.

14. Account deletion

  1. You can request deletion in the app under Settings > Account > Delete account after confirming a recent sign-in. If you cannot use the app, follow the steps on the Support page.
  2. Once you request deletion you can no longer sign in, and your data is deleted as described in the Privacy Policy.

15. Governing law and disputes

  1. These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles.
  2. However, nothing in this section excludes or limits the rights and protections that mandatory consumer-protection laws of the country where you live give you (for example, the Korean Act on Consumer Protection in Electronic Commerce and the Personal Information Protection Act).
  3. Please first contact us at support@erdcloud.com so we can try to resolve any dispute informally. If it cannot be resolved, it will be settled by the court with jurisdiction under applicable law. If you are a consumer, you may bring a claim in a court permitted by the laws of the country where you live.
